Ian Behar, Mystery Man under the gun in $150 Million city lawsuit, files for Building Permit to open store after paying January rent

WPCNR has learned that Ian Behar, the mystery man who is the target of a $150 million lawsuit leveled on him by the City of White Plains, has, after six months, filed for a building permit with the Building Department to open a store at 209 Martine Avenue.
During the last week of January, we reported to you that IWL Associates, Mr. Behar's firm, was served a notice of rent due by his landlord at 209 Martine. The notice demanded rent for the month of January, 2001. As of Thursday afternoon of last week, the Notice of Rent Due which had been posted on the door of 209 Martine, had been removed, and on Friday, a Building Permit was filed with the Building Department requesting to begin construction of the store.
Sources are speculating that Mr. Behar's legal advisors have encouraged him to demonstrate serious intent to open a business on the site to counter the City of White Plains charges that his July lawsuit against the city was a "sham" lawsuit designed to delay the construction of the Tishman Speyer Town Center.
