Council Approvals: Checks and Balances A System for Protection

WPCNR News Comment. From a WPCNR Reader. June 17, 2002. 8:15 A.M. E.D.T.: A WPCNR regular writes his concern on the Mayor's bowing to Common Council pressure not to hire a Police Commissioner from within the Public Safety Department, pointing out that it sets a disturbing precedent.
The articles on how the choice of the person to fill the position of Commissioner of Public Safety in the City of White Plains indicates a very fundamental void in leadership in our City.
The City's Charter specifically places the selection of an appointed official with the Mayor. Not the Common Council. For Mr. Delfino to abdicate that choice to the Common Council is a breach of his responsibility and indicative of his basic lack of understanding of the Office of Mayor's Charter charge.
This is more than simply a political accommodation of the Common Council wishes, they get to vote on the Mayor's recommendations via the Charter, rather it is a sheer violation of the Charter's assignment of duties to create a checks and balances of our local government.
The US Constitution does this same thing at the Federal level and the State Consitution at the State level. In White Plains Mr. Delfino has chosen to ignore this important and fundamental separation of branches of government.
These observations are not a challenge to the selection of Dr. Frank Straub to the post of Commissioner of Public Safetly, frankly his credentials seem appropriate and we wish him well.
However, if Mr. Delfino preferred one of the three internal candidates for promotion to the post of Commissioner of Public Safety as he stated, than he should have recommended that person as is his responsibility by the City's Charter. Anything less would indicate he is not following the laws of the City.
This may seem like a minor form over substance issue, but think about it. If the selection of the administrative leaders is left to the Common Council, who is going to take responsibility for the day to day management of the City? The Common Council?
They are part-time legislators by Charter provisions. Will the City's management team feel obligated to the Common Council who selected them? Where does that leave of the Office of the Mayor? Everyone should be concerned about this transfer of responsibility by the Office of the Mayor to the Common Council.
John you need to explore this issue and enlighten the readers of the real dangers that this potentially could have on the basic form of government that exists in our community.
