Environmental Lawyer Questions 221 Main Clean-Up Posted on Monday, July 18 @ 19:57:06 EDT by jfbailey

Toast of the Town!

WPCNR MR. & MRS. & MS. WHITE PLAINS VOICE. July 18, 2005: Dr. Stockman, better known as Dan Seidel, has been doing some calling to the Department of Environmental Conservation on the "cleanup" of the 221 Main construction site. He writes:

Great show the Superdeveloper puts on!! It is appreciated. But what about the 221 site? Informal conversations with PASNY confirm that the NYSD.E.C. has not signed off on the site because of the contamination - no "final work plan" has been submitted or approved for the site, due to the unexpected find of more oil tanks than anticipated and the current unknown extent of the spread of the contaminant at the officially labeled "Brown Field".

According to the D.E.C. person in charge of monitoring the cleanup, one Ram Pergadia, there is NO way to make sure the regulations and laws have been complied with in cleanup of the petroleum/oil/gasoline spills. IT IS SELF POLICING - what a laugh!!

Now with the cutbacks in D.E.C. staffing and with White Plains not knowing ANYTHING about the cleanup (ask Planning), it is up to the Superdeveloper to self police and get a certification from the "drop off point" that he has complied - HAH!!!

Fool me once - although as per information, DEC wants the digging to continue . PASNY indicates that meetings are ongoing with the Cappelli people over the lack of information and investigation and cleanup efforts. But again, the site is NOT approved for final "go forward", not just  yet, as per the NYS D.E.C. and PASNY information.

So get the citizens mellow because big things are being hidden from view. Who's tested the soil? White Plains? I think not - Planning has NO KNOWLEDGE of the plans or if certification has been issued - THE COUNCIL BEARS FAULT ON THIS ONE!!!!!!    AND THE MAYOR!!!!!

WHO IS WATCHING THE BROWNFIELD CLEANUP???? YOU WANT TO LIVE WHERE??? ON TOP OF WHAT???? LET'S GET THIS THING RIGHT FELLERS AND GALS!!!!!!

Yeah, a five star hotel/residential condo development  sitting in a maybe, questionably cleaned brownfield -

Dan Seidel
